June 16 Wii update = bad news

Reports at Wiibrew.org show that the June 16th Wii System Updates cause major problems with the Twilight Hack and with Trucha signed disks.

The June 16th, or Version 3.3 update checks for and deletes Twilight Hack and any other Twilight Princess saves exploiting the same vulnerability. However, it does not do anything to existing Homebew Channel installations. It does, however, fix the Signing bug, which prevents any “trucha”-signed discs from running, including the Homebrew Channel installer ISO versions.

This update was actually compiled on March 6th. It has probably undergone months of testing before being out, hence why it does not target any of the newer hacks.

Users are advised not to update until more information is known.

Nintendo Channel Released

Nintendo has released their product previewing channel, known creatively as the Nintendo Channel. Over at WiiBrew, it has been confirmed that this channel has no effect on the Twilight Hack or the Homebrew Channel.

New Wii Channel launched, Nintendo Channel. By the looks of it, does NOT harm the TP-Hack or Homebrew Channel in any way.

Wii Firmware 3.2

Nintendo has released version 3.2 for the Wii. In this release, some small improvements have been made. There is a new notification scroller on the Disc Channel, which will show information as the Wii Shop and News Channels do. The overall performance of the Wii Menu has been improved as well, and the Twilight Hack exploit is reported to still work fine.

This update does not affect any prominently-used features or menus; however it does provide some behind the scenes updates that will improve system performance.

This update may be obtained through a Wii message from Nintendo, or by manually starting an update through the Wii Settings menu.

Nintendo Wants U.S. to Deal with Video Game Piracy Globally

IGN is reporting that Nintendo has asked the U.S.A. to take more initiative in dealing with piracy issues worldwide. While not stating the U.S.A. is directly a problem, Nintendo wants the U.S.A. to pressure other world governments to take a stronger stance against video game piracy, and piracy enabling devices.

Nintendo of America Inc. has asked the U.S. Trade Representative to encourage specific governments around the world to take a more aggressive stance to combat piracy of Nintendo video games and systems. Nintendo filed its comments under a “Special 301″ process, in which the U.S. Trade Representative solicits input from the public to underscore specific areas of concern.

Nintendo Wii Back Up Disc 1.31

Tehskeen has reports of a Nintendo official Wii configuration disc making it out to the wild. Supposedly, this disc was left in a repaired machine, when returned to the owner.

This disc is used to restore Nintendo Wii consoles to their factory state and allows you to change some internal settings.

Installation and Sales of Modchips now Illegal in Hong Kong

TehSkeen is reporting that a law in Hong Kong has just gone into effect that makes Modchips as well as the Installation of Modchips Illegal.

From the Explanation:

Examples of the sorts of activities that would attract
civil liability:

• a person offering a service to modify game consoles or
selling mod chips for insertion into digital game machines so
as to enable others to play pirated computer games

To combat the rampant sale of modified game consoles and other
tools which help the public to pirate copyright works, we propose
to criminalize the making, importation or export for sale,
or dealing in any circumvention tools. We will also criminalize
the commercial provision of circumvention services.

Wii Opera SDK - Nothing New

Some other Wii news sites (we wont name names) are erroniously reporting that Nintendo has opened up the Wii Opera SDK. This is not the case. The Hullbreach SDK is an independently developed set of homebrew tools for making Wii Browser apps.

Not only is this not an official Nintendo release, it’s not even new. Our readers may recall that reported on on the Wii Opera SDK not once but twice, earlier in August and no major changes have occured since.
While we don’t normally post corrections for news on other sites, it would seem that this particular story has snowballed quite a bit and with the number of reports we’ve received about it, we felt it necessary to post a statement.

Regardless, the Hullbreach Wii Opera SDK is still a fantastic homebrew product, arguably the best Wii Opera SDK available. We encourage those interested in developing Wii homebrew for the Opera Browser to try it.

Nintendo’s Open Source OS, Labeled ‘ES’

OSNews is reporting Nintendo is developing ‘ES’, an Open-Source OS hosted at nes.sourceforge.jp (translation). The OS is still in the research phase, which means nothing may ever come from it. Alternatively, it could possibly be used as a sort of ‘XNA’ clone, or it may be used as a full scale End-User Operating System.

ES is a fairly interesting looking open source research OS created by Nintendo. Runs natively on x86 (and qemu of course), kernel is written in C++, uses an ECMAScript interpreter for all of the userland, uses Cairo for graphics, and even has a port of Squeak.

Nintendo Ordered by the Hong Kong High Court to Remove Press Release from Its Website

Max Louarn, propriator of MaxConsole, with strong connections to Divineo, SupremeFactory, Memor32, Memento, DMS, Viper, Cobra, UP Mod, Epsilon, CycloWiz, Cyclops, Wiid, et al. has laid claim that Nintendo has voilated their agreement not to divulge details of recent SupremeFactory Raid “except for the purposes of the proceeding”.

The Press Release:

HONG KONG, Dec. 3 /Xinhua-PRNewswire/ — On 22 October 2007, Nintendo of America Inc (”Nintendo”) issued a press release, which was wrong insofar as it may have suggested that a final, substantive judgment on intellectual property right infringement has been handed down by the Court against Supreme Factory Limited (”Supreme”), on its website http://www.nintendo.com and publicised it to popular gaming sites.

In the proceedings before the High Court Supreme seeks to overturn the pre-trial injunctions and will vigorously oppose the Nintendo’s claims that they have infringed its intellectual property rights. Supreme has already managed to obtain an order from the High Court to unfreeze a significant amount of money to allow Supreme to meet its ordinary and proper business expenses in respect of product which is not the subject of the proceedings.

The Press Release was correct insofar as it reported that the Hong Kong High Court had granted certain pre-trial injunctive relief, allowing Nintendo representatives to search the premises of Supreme in Hong Kong. The search was for items which Nintendo alleges breach its intellectual property rights in the Nintendo DS and Wii systems. The Court also ordered that certain of Supreme’s assets be frozen.

On 2 November 2007 the Hong Kong High Court ordered Nintendo to remove the Press Release from its website. In issuing the Press Release Nintendo had breached an implied undertaking not to use information and/or documentation obtained as a result of a search order carried out on Supreme’s premises except for the purposes of the proceeding.

On 19 November 2007, the High Court further ordered Nintendo to disclose to Supreme the names and contact details of all persons or organisations to whom Nintendo (or anyone acting on its behalf and/or anyone under its control) has provided the Press Release.
